1 · About Activo
Activo is operated by Mostafa Wafik, of Cairo, Egypt ("Activo", "we", "us").
Activo is a platform where people discover activities, form groups and take on challenges, and where operators list activities they run. Activo is not the organiser of the activities listed on it. What that means in practice is set out in sections 5 to 8, and it is the most important thing in this document.
2 · Your account
- You must be at least 13 years old to use Activo.
- Use your real identity, one account per person, and keep your password to yourself.
- You are responsible for what happens under your account.
- Tell us straight away if you think someone else has access to it.
- You can delete your account at any time from Settings. We may close an account that breaches these terms, as described in section 9.
3 · How you may use Activo
The community guidelines form part of these terms, and set out what is not allowed. In addition, you agree not to:
- Scrape, copy or harvest data about other people.
- Interfere with the service, probe it for weaknesses, or try to access accounts that are not yours.
- Use Activo to advertise unrelated products or services.
- Charge for an activity without being an approved operator.
- Misrepresent an activity, its price, its difficulty or what it includes.
4 · Your content
What you post stays yours. You keep ownership of your photos, posts, messages and listings.
To run the service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content inside Activo, and to show it to the audience you chose. This licence exists only so Activo can work, and it ends when you delete the content or your account — except for copies already shared with others, and for backups, which cycle out as described in the privacy policy.
We may remove content that breaches these terms or the community guidelines. We do not pre-screen content, but we do review it when it is reported.
5 · Operators
An operator is a person or business approved by us to list activities and take bookings.
- Approval is at our discretion, and we review the information you provide. Approval is not an endorsement, a certification or a guarantee of an operator's competence, licensing, insurance or safety record.
- Operators are independent. They are not our employees, agents or partners, and they contract directly with the people who book them.
- Operators are responsible for holding any licence, permit or insurance their activity requires, for running the activity safely, and for honouring what they advertised.
- Operators must publish their own cancellation and refund terms, and must honour them.
- We may suspend or revoke operator status at any time, as described in section 9.
6 · Bookings and payment
Activo does not process payments and does not hold your money. When you book an activity, you pay the operator directly, by whatever method they have specified. You upload proof of that payment, and the operator confirms it. Activo records the confirmation and nothing more.
This means:
- The contract for the activity is between you and the operator, not with Activo.
- Prices, deposits, cancellation terms and refunds are set by the operator and are a matter between you and them.
- We cannot issue refunds, because we never received the money.
- If an operator takes payment and does not deliver, tell us. We cannot recover your money, but we can and do remove operators who do this.
Activo is currently free to use. If we introduce fees, we will tell you before they apply to you.
7 · Activities happen in the real world
Activo is a way to find people and activities. The activity itself — the hike, the dive, the class, the trip — happens away from the app, between real people, and carries real risk.
- We do not verify individual members. We do not run background checks on the people you meet through Activo.
- You decide what you are capable of. Assess an activity against your own fitness, skill and health before booking, and ask the operator if you are unsure.
- You participate at your own risk, and you are responsible for your own insurance, equipment and safety decisions.
- Follow the safety advice in the community guidelines, particularly when meeting someone for the first time.
8 · What we are responsible for
We provide Activo as it is. We work to keep it running and accurate, but we do not promise that it will be uninterrupted, error-free, or that any listing is accurate.
To the fullest extent the law allows, we are not liable for:
- Injury, loss or damage arising from an activity you found through Activo;
- The conduct of any member or operator, online or in person;
- Money you paid an operator;
- Content posted by other people;
- Indirect or consequential loss of any kind.
Nothing in these terms excludes liability that cannot be excluded by law — including for death or personal injury caused by our own negligence, or for fraud.
9 · Suspension and removal
If you breach these terms or the community guidelines, we may remove content, issue a warning, suspend your account temporarily, revoke operator status, or remove your account permanently. We take the seriousness of the breach into account, and serious breaches skip the warning.
We will tell you what happened and why, unless telling you would compromise an investigation or someone's safety. You can appeal through support, and a different person will review it.
10 · Intellectual property
The Activo name, logo, design and software belong to us. These terms do not give you any right to use them, beyond using the app as intended.
11 · Changes to the service and these terms
We will keep developing Activo, which means features change and some are removed. If we change these terms in a way that materially affects you, we will tell you in the app before it takes effect. Continuing to use Activo afterwards means you accept the change; if you do not, you can delete your account.
12 · Governing law
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Cairo, Egypt have exclusive jurisdiction over any dispute.
